Terms of Service

These Terms of Service (“Terms”) govern your use and purchase of the eSIM product (“Service”) provided by Big Sky Travel eSIM (“we”, “us”, or “our”). By purchasing or activating the eSIM, you agree to comply with and be bound by these Terms.

 

1. Eligibility and Device Compatibility

  • This Service is available only to users with unlocked and eSIM-compatible devices.

  • It is your responsibility to verify compatibility before purchase. No refunds will be issued for devices that do not support eSIM or are network-locked.

2. Service Description

  • The eSIM provides mobile data connectivity only (no SMS or voice unless otherwise stated).

  • Service coverage, speed, and stability may vary by location and depend on local carrier networks.

  • The eSIM is intended for mobile phone use only and is not compatible with routers, pocket Wi-Fi, or other hotspot devices.

3. Activation and Validity

  • Each eSIM plan comes with a specified validity period (e.g., 7 days, 15 days) and data allocation.

  • The validity period begins upon activation, either automatically (upon connection) or manually as stated in the product instructions.

  • Unused data does not roll over. The eSIM cannot be paused, reactivated, or extended once the validity expires.

4. Usage Policy

  • Use of the Service is subject to Fair Usage Policies (FUP) of our partner networks. Speed may be reduced once the data cap is reached.

  • We reserve the right to limit or suspend service in case of misuse, including unauthorized sharing, tethering beyond permitted limits, or fraudulent activity.

5. Refunds and Cancellations

Refunds will only be issued under the following conditions:

  • The eSIM could not be activated due to a verified technical issue on our side.

  • The eSIM was not yet used or downloaded, and the request was made within [X] days of purchase.

Refunds will not be granted for:

  • Device incompatibility or locked phones

  • Misuse or incorrect installation

  • Failure to activate within the specified time window

  • Network-related issues beyond our control

6. Limitation of Liability

We shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

  • Service interruptions due to third-party carrier issues

  • Loss of business, profits, or data from connectivity failure

  • Incompatibility or malfunction of your device

7. Data Privacy

We collect and process your data in accordance with our Privacy Policy, available here. Personal data is used strictly for service delivery, customer support, and compliance with applicable regulations.

8. Modifications

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website www.bigskyesim.com. Your continued use of the Service constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Philippines, without regard to its conflict of laws provisions.
